The US Constitution forbids the government from passing a law interfering with the obligation of contracts. Employees and employers could agree in writing that an employee has sovereign rights to make their own health decisions. This would protect both employee and employer from attempted government health mandates and penalties but would not change the general concept of employment at will in regard to other matters.
