Earlier this year, Idaho legislators tried to pass House Bill No. 750 (HB 750) to define programmable money and regulate its use. Among other features, the bill would have amended two sections of Idaho Code to exclude programmable money from the definitions of “money” and “deposit account,” and, drawing from Solari’s model legislation (the “Consumer Payment Rights and Transparency Act”), would also have created a new chapter of Idaho Code to define programmable money and set parameters for its use.
HB 750 passed out of the Idaho House. Senator Tammy Nichols was the sponsor in the Senate and did a remarkable job of educating her colleagues. The bill did not pass but it achieved essential progress thanks to Nichols’ efforts winning 13 Ayes (versus 21 Nays and one absence). As more and more legislators come to understand the importance of states putting guardrails on programmable money, we are hopeful for passage in 2027.
Sen. Nichols has served in the Idaho legislature since 2018, spending two terms in the House before winning election to the Senate (District 10) in 2022. There, she chairs the Senate Agriculture committee—where she looks out for farmers, ranchers, and small business owners—and also serves on the Commerce and Human Resources and Education committees. Nichols has supported a wide range of bills focused on, among other priorities, government transparency and health freedom.
Sen. Nichols co-chairs the Idaho Freedom Caucus with Rep. Heather Scott (one of HB 750’s sponsors in the House), where the two work “to defend freedom and the values that make Idaho strong.” They love their state, are utterly loyal to the people they serve, and are hard-working and great communicators.
